The FDA says it is aware that flavored e-liquids are usually popular with young adults, but that young adults also need to be protected contrary to the over-selling of the products by adult consumers. According to the FDA’s warning letters, some of the e-liquids in question had no flavor; however, they were being offered for sale in candy bars disguised as a healthy snack.
Cool Cloud Vapor had marketed its e-liquid product as a dietary supplement and a sports drink. These statements were misleading, the FDA claims, because no FDA regulatory expectations or laws exist to regulate health supplements and sports drinks. The business’s application for a non-prescription industry distribution label especially stated that the product could be used as a supplement. It was not designed for use as a sports sip or an athletic supplement, according to the FDA.
